GENERAL PROVISIONS
These conditions are valid exclusively between the company Debet's srl with share capital of 10,000.00 iv with headquarters in via C. Colombo, 14/D – 30021 Mogliano Veneto (TV) VAT number 04971000262 and any person who makes online purchases on the website debets.it hereinafter referred to as the "CUSTOMER".
These conditions may be subject to change and the date of publication of the same on the site is equivalent to the date of entry into force.
These conditions govern purchases made on the debets.it website, in accordance with the provisions of Part III, Title III, Chapter I of the Consumer Code, Legislative Decree no. 206/2005, amended by Legislative Decree no. 21/2014 and Legislative Decree 70/2003 on electronic commerce.
ARTICLE 1 – OBJECT OF THE CONTRACT
With these general conditions of sale, DEBET'S srl sells and the CUSTOMER purchases remotely the tangible movable goods indicated and offered for sale on the Debets.it website. The contract is concluded exclusively through the Internet, by the CUSTOMER accessing the address debets.it and placing a purchase order according to the procedure provided by the website itself.
The customer undertakes to read, before confirming his order, these general conditions of sale, in particular the pre-contractual information provided by DEBET'S srl and to accept them by placing a flag in the indicated box.
In the order confirmation email, the CUSTOMER will also receive the link to download and archive a copy of these general conditions of sale, as required by art. 51 paragraph 1 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014.
ARTICLE 2 – PRE-CONTRACTUAL INFORMATION FOR THE CONSUMER – ART. 49 OF LEGISLATIVE DECREE 206/2005
Before concluding the purchase contract, the CUSTOMER examines the characteristics of the goods which are illustrated in the individual product sheets at the time of the choice by the CUSTOMER.
Before validating the order with “payment obligation”, the CUSTOMER is informed of:
– total price of the goods including taxes, with details of shipping costs and any other costs;
– payment method;
– the deadline by which DEBET'S srl undertakes to deliver the goods;
– conditions, terms and procedures for exercising the right of withdrawal (art. 6 of these conditions) as well as the standard withdrawal form referred to in Annex I, Part B of Legislative Decree 21/2014;
– information that DEBET'S srl will have to bear the cost of returning the goods in the event of withdrawal;
– existence of the legal guarantee of conformity for the goods purchased;
– after-sales assistance conditions and commercial guarantees provided by DEBET'S srl.
The CUSTOMER may at any time and in any case before the conclusion of the contract, take note of the information relating to DEBET'S srl, the geographical address, telephone number, email address, information which is also reported below:

ARTICLE 3 – CONCLUSION AND EFFECTIVENESS OF THE CONTRACT
The sales contract is considered concluded with the sending by DEBET'S srl to the CUSTOMER of an order confirmation email. The email contains the CUSTOMER's data and the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent and the link to print and archive a copy of these conditions.
The CUSTOMER undertakes to verify the accuracy of the personal data contained in the above email and to promptly communicate to DEBET'S srl any corrections/modifications to be made.
DEBET'S srl is committed to describing and presenting the items sold on the site in the best possible way. However, some errors, inaccuracies or small differences between the product depicted on the site and the actual product may arise. Furthermore, the photographs of the products presented on debets.it do not constitute a contractual element, as they are to be considered only representative.
DEBET'S srl undertakes to deliver the goods within 30 days from the date on which DEBET'S srl itself sends the order confirmation email to the CUSTOMER.
ARTICLE 4 – PRODUCT AVAILABILITY
Product availability refers to actual availability at the time the CUSTOMER places the order. However, such availability must be considered purely indicative as:
– the products could be sold to other CUSTOMERS before the order is confirmed, due to the simultaneous presence of multiple users on the site;
– a computer anomaly could occur that makes a product available for purchase that in reality is not.
Even after sending the order confirmation email sent by DEBET'S srl, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically corrected by eliminating the unavailable product or products and the CUSTOMER will be immediately informed by email; with this email the customer will also be informed of the methods and timing of reimbursement of any sums paid.
ARTICLE 5 – PAYMENT METHODS
All payments by the CUSTOMER may only be made using the credit cards indicated on the Debets.it website, by bank transfer, by Paypal payment method or by cash on delivery.
In case of payment with Paypal, the actual charge will take place when DEBET'S srl sends the order confirmation email.
Communications relating to payment and the data communicated by the CUSTOMER when this is carried out take place on special protected lines. The security of payment by Credit Card is guaranteed by VBV (Verified by VISA) and SCM (Security Code Mastercard) certification.
ARTICLE 6 – PRICES
All sales prices of the products indicated on the debets.it website are expressed in Euros and include VAT and, where applicable, the WEEE contribution.
Shipping costs are not included in the purchase price, but are indicated and calculated at the end of the purchase process before payment is made.
The CUSTOMER accepts the right of DEBET'S srl to modify its prices at any time, however the goods will be invoiced on the basis of the prices indicated on the site at the time of creation of the order and indicated in the confirmation email sent by DEBET'S srl to the CUSTOMER.
In the event of an IT, manual, technical, or any other error that may result in a substantial change, not foreseen by DEBET'S srl, in the retail price, making it exorbitant or clearly derisory, the purchase order will be considered invalid and cancelled and the amount paid by the CUSTOMER will be refunded within 14 days from the day of cancellation.
ARTICLE 7 – RIGHT OF WITHDRAWAL
If for any reason the customer is not satisfied with their purchase, unworn items can be returned for size/color exchange or product replacement within 14 days from the date of receipt of the goods.
In case of exercising the right of withdrawal, the CUSTOMER is required to return the goods within 14 days from the day on which he communicated to DEBET'S srl his intention to withdraw from the contract pursuant to art. 57 of Legislative Decree 206/2005.
Shipping costs will be borne by the customer both in the case of return to Debet's and new delivery to the customer unless new goods are purchased for amounts exceeding 150 euros. The items must have labels, packaging as new and the required tax documents.
The CUSTOMER who intends to exercise the right of withdrawal must communicate this to DEBET'S srl via an explicit declaration, which may be sent via registered mail, via PEC or via customer service by sending an email to debets@gmail.com.
The goods must be returned to DEBET'S srl.
The goods must be returned intact, in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.) and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, DEBET'S srl will replace the product.
As provided for by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, DEBET'S srl may suspend the refund until receipt of the goods or until the CUSTOMER has demonstrated that he has returned the goods to DEBET'S srl.
*It is understood that in the event of a product defect, shipping costs will in any case be borne by DEBET'S srl.
ARTICLE 8 – LEGAL GUARANTEE OF CONFORMITY
In the event of receipt of defective products or products that do not conform to the orders placed, the CUSTOMER has the right to restore the conformity of the product at no cost by repairing or replacing the product. The CUSTOMER can exercise this right if the defect becomes apparent upon receipt of the goods and reports the defect to DEBET'S srl within 7 days of discovery. In order to exercise the above right, the customer must proceed to create a computerized Return practice by accessing the "My orders" section of the "My online account" space on the DEBET'S srl.it website. DEBET'S srl, in the event of a defective or non-compliant product, will, at its own expense, organize the collection of the product, compatible with the CUSTOMER's availability. To benefit from warranty assistance, the CUSTOMER must keep the invoice that can be printed by accessing the "My orders" section of the "My online account" space.
ARTICLE 9 – DELIVERY METHODS
The products will be delivered by express courier to the address indicated by the CUSTOMER at the time of the order within and no later than 30 days from the date of receipt by the CUSTOMER of the order confirmation email sent by DEBET'S srl.
For each order placed on the debets.it website, DEBET'S srl issues an invoice for the goods shipped. The invoice is available and printable, after the order has been processed, in the "My orders" section of the CUSTOMER's "My account" space. The invoice will contain the information provided by the CUSTOMER during the purchase procedure. After the invoice has been issued, it will not be possible to make any changes to the data indicated in the invoice.
ARTICLE 10 – RESPONSIBILITY
DEBET'S srl assumes no responsibility for disruptions attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disruptions of the internet network, in the event that it is unable to execute the order within the timeframes set out in the contract.
ARTICLE 11 – ACCESS TO THE SITE
The CUSTOMER has the right to access the site for consultation and purchases. No other use, in particular commercial, of the site or its content is permitted. The integrity of the elements of this site, whether audio or visual, and the related technology used remain the property of DEBET'S srl and are protected by intellectual property rights.
ARTICLE 12 – COOKIES
The website debets.it uses "cookies". Cookies are electronic files that record information relating to the CUSTOMER's navigation on the site (pages consulted, date and time of consultation, etc.) and that allow DEBET'S srl to offer a personalized service to its customers.
DEBET'S srl informs the Customer of the possibility of deactivating the creation of such files by accessing their Internet configuration menu. It is understood that this will prevent the Customer from proceeding with the online purchase.
ARTICLE 13 – INTEGRALITY
These General Conditions of Sale are constituted by all the clauses that compose them. If one or more provisions of these General Conditions of Sale are considered invalid or declared as such pursuant to the law, regulation or following a decision by a court having jurisdiction, the other provisions will continue to have full force and effect.
ARTICLE 14 – APPLICABLE LAW AND JURISDICTION
These General Conditions of Sale are subject to Italian law.
Any dispute that cannot be resolved amicably will be submitted to the exclusive jurisdiction of the Court of the place of residence or domicile of the CUSTOMER, if located within the territory of the State.
